| ToxicTort.cc is a law firm with
5 attorney members and 3 additional
lawyers who are “of counsel”
to the firm. All members of the firm
are licensed to practice in Kentucky
and the attorneys have represented clients
in state and federal courts throughout
the Commonwealth. Members of the firm
are also licensed by, and represent
clients in, the states of Indiana and
Florida. The members have also represented
clients along with co-counsel in other
states including Alabama, Ohio, and

| TOXIC TORTS |

| A Toxic Tort is, by its broadest definition,
an injury to humans or property by a substance which is
known or suspected to cause increased human morbidity
or mortality. As you will notice from the resumes of the
members of the Firm, their backgrounds in Engineering
and Medicine along with their experience with personal
injury cases provide a good basis to practice in the area
of Toxic Torts. The Members have represented thousands
of injured parties who's property has been devalued or
who have become ill from their exposure to toxic chemicals
such as PCBs, TCE, VC, etc. The members have also represented
persons injured as a result of taking prescription drugs
such as Baycol, Vioxx, etc. |

| In general, in order to proceed with a
toxic tort case, you must be able to prove that the substance
is toxic, that you have been exposed to the toxic substance,
and that the exposure was a substantial factor in causing
your injury. In order to determine if a substance is toxic,
there are two Federal agencies which can help you get
started. They are ATSDR, http://www.atsdr.cdc.gov/toxfaq
and USEPA, http://www.epa.gov.

| If you suspect that you have been exposed
to toxic substances from some type of site, there are
several good places to start looking for information about
a site. First, there is USEPA or your state version of
the EPA. You can make a Freedom of Information Act request
(FOIA), http://www.epa.gov/foia,
or often there will be a local repository of documents
regarding a site. You can obtain information about Superfund
Sites in you area at http://cfpub.epa.gov/supercpad/cursites. |

| If you believe you or a family member have
been damaged as a result of a toxic substance, you should
contact an attorney as soon as possible. Most states have
laws which require that a suit be brought with in a certain
time period called a statute of limitations. You can contact
